By creating an account, accessing the platform, or using any HR Khata services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

  • Comply with all applicable laws and regulations.

Organizations are responsible for the actions of their authorized users.

  • Protect login credentials from unauthorized access.
  • Notify us immediately of any suspected security breach.

HR Khata reserves the right to suspend or terminate accounts that contain false or misleading information.

5. Use of Services

HR Khata grants customers a limited, non-exclusive, non-transferable license to access and use the platform for internal business purposes.

Users agree not to:

  • Reverse engineer, modify, or copy the software.
  • Attempt unauthorized access to systems or data.
  • Distribute malware or harmful code.
  • Use the platform for unlawful activities.
  • Interfere with the operation or security of the services.

6. Subscription and Payment

Certain HR Khata services may require a paid subscription.

Customers agree to:

  • Pay applicable fees according to the selected plan.
  • Provide accurate billing information.
  • Make payments within the agreed payment period.

Failure to pay subscription fees may result in account suspension or termination.

Unless otherwise stated, all fees are non-refundable.

7. Data Ownership

The customer retains ownership of all employee, payroll, attendance, leave, and business information stored within HR Khata.

HR Khata does not claim ownership of customer data.

Customers are responsible for ensuring they have the necessary rights and permissions to upload and process information through the platform.

8. Data Processing

HR Khata processes information solely for the purpose of delivering the services requested by customers.

We implement reasonable security measures to protect customer data; however, customers remain responsible for:

  • Verifying payroll outputs.
  • Reviewing generated reports.
  • Maintaining internal compliance requirements.
  • Backing up critical business records where appropriate.

9. Service Availability

We strive to maintain reliable service availability but do not guarantee uninterrupted access.

Temporary interruptions may occur due to:

  • Scheduled maintenance
  • System upgrades
  • Technical issues
  • Internet service disruptions
  • Events beyond our reasonable control

HR Khata shall not be liable for downtime resulting from such circumstances.

10. Intellectual Property

All rights, title, and interest in the HR Khata platform, including software, design, content, trademarks, logos, and technology, remain the property of HR Khata or its licensors.

Nothing in these Terms grants ownership rights to customers beyond the limited license to use the platform.

11. Limitation of Liability

To the maximum extent permitted by law, HR Khata shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits or revenue
  • Business interruption
  • Loss of data resulting from user actions
  • Errors caused by inaccurate information provided by users

The customer is responsible for reviewing payroll calculations, tax deductions, employee records, and compliance-related outputs before use.

12. Indemnification

Customers agree to indemnify and hold HR Khata harmless from claims, liabilities, damages, losses, and expenses arising from:

  • Misuse of the platform
  • Violation of these Terms
  • Breach of applicable laws
  • Infringement of third-party rights

13. Suspension and Termination

HR Khata may suspend or terminate access to the platform if:

  • These Terms are violated.
  • Subscription fees remain unpaid.
  • Fraudulent or unlawful activity is detected.
  • Platform security is compromised.

Customers may discontinue use of the service at any time, subject to applicable subscription obligations.

14. Confidentiality

Both parties agree to maintain the confidentiality of non-public information exchanged during the course of the business relationship.

Confidential information shall not be disclosed to third parties except as required by law or with prior consent.

15. Third-Party Integrations

HR Khata may integrate with third-party services, including accounting, communication, or payment platforms.

We are not responsible for:

  • Third-party service availability
  • Data handling practices of third parties
  • Changes made by third-party providers

Users should review the applicable terms and policies of any integrated services.

16. Changes to Terms

HR Khata reserves the right to modify these Terms & Conditions at any time.

Updated versions will be posted on this page with a revised effective date. Continued use of the platform after updates constitutes acceptance of the revised Terms.

17. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Nepal.

Any disputes arising from the use of HR Khata shall be subject to the jurisdiction of the courts of Nepal.
